When overtime is legally required

Under the US Fair Labor Standards Act, non-exempt employees must be paid at least 1.5× their regular rate for hours worked beyond 40 in a workweek. There is no federal requirement for daily overtime, though several states — California most notably — add their own rules after 8 hours in a day. Exempt salaried employees are not entitled to overtime at all, which is what the exemption means.

The regular rate is not always your hourly rate

For overtime purposes the regular rate includes non-discretionary bonuses, shift differentials and commissions, divided across the hours worked. If you earn a production bonus, your true overtime rate is higher than 1.5× your base hourly figure.
